| | | GRATA International Beijing provided a legal support for the exclusive distribution deal of a premium Chinese electric car brand ZEEKR in Kazakhstan
GRATA International Beijing has successfully provided a legal support in the exclusive distribution deal of the premium brand of Chinese electric cars ZEEKR in the Republic of Kazakhstan. The right to officially service and sell ZEEKR brand intelligent electric vehicles in Kazakhstan was granted to Orbis Auto.
An exclusive distribution agreement was signed by one of the companies within Orbis Auto and the Chinese company ZEEKR Intelligent Technology.
According to Forbes Kazakhstan, a network of branded dealership centers will be opened in eight cities across Kazakhstan. Deliveries of the first cars will begin in the fourth quarter of this year. The distributor will also provide specialized service for cars of this brand with a warranty.
To date, ZEEKR supplies premium electric cars of the brand to the PRC market, and also announced plans to sell on the markets of the European Union and Israel. In the future, Orbis Auto intends to develop a network of electric charging stations, including between the cities of Kazakhstan. | | | Russian ministry of foreign affairs proposes to oblige russians abroad to inform about obtaining another citizenship or residence permit
The Russian Ministry of Foreign Affairs has drafted an order which would oblige Russians living in other countries to notify embassies of the receipt of documents confirming the right of residence.
The Ministry has posted the draft departmental order on the federal portal of draft regulatory legal acts (regulation.gov.ru).
The draft order states that Russians who have received or lost a residence permit, citizenship or other document confirming the right to permanent residence in a foreign country must notify the Russian consulate or embassy within 60 days.
The period for notification is counted from the date of receipt of the documents and differs for those living in Russia and those living abroad. If a citizen is present in Russia when obtaining citizenship or residence permit in another country, the notification must be submitted within 60 days.
| | | Presidential decree on suspension of certain provisions of international tax treaties of the Russian Federation published
On 15.03.2023 the Ministry of Finance of Russia and the Ministry of Foreign Affairs of Russia made a proposal to the President of the Russian Federation to issue a decree on suspension of double taxation agreements with all countries that have imposed unilateral economic restrictive measures against Russia. The said agreements were proposed to be suspended until Russia's violated rights were restored.
On 08.08.2023 the Decree of the President of the Russian Federation dated 08.08.2023 No. 585 "On Suspension by the Russian Federation of Certain Provisions of International Tax Treaties of the Russian Federation" was officially published.
The Decree provides for temporary suspension of certain provisions of agreements on avoidance of double taxation with unfriendly foreign states until the latter eliminate violations of the legitimate economic interests of the Russian Federation, the rights of its citizens and legal entities or until the termination of these international treaties. | | | The Lawyers of GRATA International have successfully accompanied the re-domicile of one of the largest mining conglomerates in the world to the AIFC
GRATA International Partners Mr. Baizhan Bekzhanov and Mr. Maxim Burak, as well as Counsel Ms. Aruzhan Aimak delivered legal support under Kazakh law during the relocation of a large gold mining company from Jersey island (the UK Crown Dependency) to the jurisdiction of the Astana International Financial Centre (AIFC).
It is a reminder that the re-domicile is a unique opportunity for a company to "move" from one country to another without liquidation, transfer of assets, or termination of its contracts. Importantly, for the purposes of the re-domicile, such a procedure must be permitted by the laws of both "donor" and "recipient" countries. Re-domicile is not allowed under regular Kazakhstani legislation but is available in the AIFC.
The project is the first case of relocation of a listed company and the third case of re-domicile to the AIFC. | | | New law on public – private partnership
The Parliament of Mongolia enacted the Public-Private Partnership Law (“PPP Law”) based on the research of model law on Public-Private Partnership and its handbook replacing the previous Law on Concession (2010) on 9th December, 2022 and coming into effect on 31st December, 2023.
The new law clarifies the purpose, scope, principles, terms and understanding of public-private partnership and distinctly defines the legal framework for implementation of major infrastructure, social and economic goals of the country and the plenary powers and functions of public institutions in public-private partnerships by implementing puablic infrastructure and public service functions through private investment on mutually beneficial terms. Also creates a legal environment for implementing financial and budget control by improving coordination between these organizations related to the implementation of partnership projects.
| | | Tax control in the Republic of Kazakhstan
The Tax Code of Kazakhstan provides for a wide range of tax control forms, with the main ones being cameral tax control and on-site tax inspections.
Tax control is carried out by tax authorities, as well as customs authorities in relation to VAT on imports and excise duties payable in connection with the movement of goods across the border.
Any act as well as action (inaction) of the tax authority can be appealed by the taxpayer to a higher tax authority and/or courts, if they consider them unlawful and unjustified. Due to the digitalization of tax administration, tax authorities have widely implemented cameral tax control.
Within the framework of cameral control, tax authorities remotely monitor and analyze tax reporting and other documents submitted by taxpayers, as well as other information about taxpayers received from government agencies and other sources. | | | GRATA International Astana held the semi-annual reporting conference
