First of all, we bring to your attention the updated Charter of EUEA (which was amended at the General Meeting of the EUEA on 18.12.2020), as well as the Code of Conduct of EUEA members (adopted at the meeting of the EUEA Board on 12 January 2021). 

January 15, 2021
- The NEURC adopted amendments to Resolution №641 on liability for imbalances, taking into account in part the proposals sent by EUEA and other associations.
- The NEURC has removed from the draft Resolution the article on the final recipient of the attracted loan from NPC Ukrenergo under state guarantees.
- In an interview with Interfax, the Prime Minister of Ukraine noted that 50% of the loan received by NPC Ukrenergo under state guarantees should be used to repay the debt to NNEC Energoatom.

January 16, 2021

- The NEURC has issued an "instruction" (not a type of legal document and not a regulatory legal act) that SE "Guaranteed Buyer" must send at least 50% of funds to NNEC "Energoatom", which will amount to UAH 5.1 billion.

Thus, at present, loans under state guarantees for NPC Ukrenergo from three state-owned banks have been approved by the NEURC, and the question of who will receive these funds and in what amount remains open.

Last week, the EBRD and the Energy Community Secretariat sent letters to the NEURC regarding the need to comply with the Memorandum on repayment of debts to RES Producers, and with the warning that the NEURC's decision to redistribute funds not in favor of RES could lead to an escalation of the conflict with investors, disputes and deteriorating investment climate.

Guaranteed Buyer

As of January 15, the settlements with RES producers for August-November 2020 was 100%, December 2020 - 11.5%, January 2021 - 10.8%
GB began to publish the deviations between the forecasted production and the actual production of electricity of RES on the main page of the website.

Шановні члени ЄУЕА,

Перш за все до Вашої уваги оновлений Статут ЄУЕА (зміни до якого були внесені на Загальних зборах ЄУЕА 18.12.2020), а також Кодекс етичної поведінки членів ЄУЕА (прийнятий на засіданні Ради ЄУЕА від 12 січня 2021 року).

15 січня 2021 року
- НКРЕКП було прийнято внесення змін до Постанови №641 про відповідальність за небаланси, з частковим врахуванням пропозицій, що надсилалися ЄУЕА та іншими асоціаціями.
- НКРЕКП прибрало пункт про кінцевого отримаувача коштів залученого кредиту НЕК "Укренерго" під державні гарантії. 
- Прем'єр-міністр України в інтерв'ю Інтерфакс заначив, що 50% отриманого кредиту НЕК "Укренерго" під державні гарантії, має бути направлено на погашення боргу перед НАЕК "Енергоатом". 

16 січня 2021 року

НКРЕКП видало "настанову" (не є видом юридичного документу та не є нормативно-правовим актом) що ДП "Гарантований покупець" має відправити не менше 50% коштів на НАЕК "Енергоатом", що складатиме 5,1 млрд грн. 

Таким чином, наразі кредити під державні гарантії для НЕК "Укренерго" від трьох державних банків погоджені НКРЕКП, порушене питання про те, кому ці кошті врешті і в якому розмірі мають надійти - залишається відкритим.

На минулому тижні ЄБРР та Секретаріат Енергетичного співтовариства надіслали листи на НКРЕКП щодо необхідності виконання умов Меморандуму про погашення заборгованості перед виробниками е/е з ВДЕ, та із застереженням що рішення НКРЕКП про перерозподіл коштів не на користь ВДЕ може призвести до загострення конфлікту з інветсорами, судових спорів та погіршенню інвестиційного клімату.

Становм на 15 січня розрахунок за серпень-листопад 2020 року складає 100%, грудень  2020 - 11,5%, січень 2021 - 10,8 %
Почав публікувати відхилення між прогнозованим виробництвом та фактичним виробництвом е/е з ВДЕ на головінй сторінці вебсайту.
