As a recall, according to the signed Memorandum of Understanding between the Government of Ukraine, the NEURC and industry associations, 40% of the debt for 2020 supposed to be repaid by the end of 2020, and for this purpose, the Cabinet of Ministers had to provide state guarantees for the Ukrenergo loan. In this regard, amendments were made to the legislation, which gave the following powers to the Cabinet of Ministers, where the accompanying explanatory notes stated the purpose of loans under state guarantees, namely - repayment of debts to RES producers. The NEURC, is going to adopt the Resolution about prohibiting the Guaranteed Buyer from transferring these funds to repay debts in the RES sector. Such NEURC's decision is contrary to current legislation and is beyond the powers of the Regulator. Нагадаємо, що згідно підписаного Меморандуму про Взаєморозуміння між Урядом України, НКРЕКП та галузевими асоціаціями, було передбачено погашення 40% боргу за 2020 рік ,і саме для цієї мети Кабінет Міністрів мав надати державні гарантії для отримання кредиту "НЕК "Укренерго". У зв'язку з цим було внесено зміни до законодавства, що надали такі поноваження Уряду України, де у супровідних пояснювальних записках було зазначено цільове призначення кредитних коштів, на які надаються державні гарантії, а саме - погашення заборгованості перед виробниками електричної енергії з ВДЕ. Таким чином, рішення НКРЕКП, яке вона планує прийняти, заборонивши Гарантованому покупцю перерахувати ці кошти на погашення боргів у секторі ВДЕ, суперечить чинному законодавству, та виходить за межі повноважень Регулятора. Усі листи були англомовних варіантах та розіслані посольствам, міжнародним фінансовим інституціям, включаючи МВФ. Нещодавно нам стало відомо, що представники міжнародної спільноти вже надіслали листи до НКЕКП у підтримку сеткору ВДЕ.
