Dear EUEA members,

With this letter we would like to inform you about the following:

1. Last week as you remember EUEA sent a letter to the NEURC with proposals on the Draft Resolution of the NEURC “On approval of amendments to the Resolution of the NEURC from April 26, 2019 №641" on responsibility for imbalance asking: 

• To not reduce the calculation of the cost of the service to increase the share of electricity production from RES by 20%, as this 20% was not provided by the State Budget of Ukraine.
• Compensation should be clearly defined as a “service” provided by the Guaranteed Buyer to RES producers to address their imbalances (a VAT-taxable transaction) that will allow both parties to pay VAT.
• To delete the article about the following: late payment for settlement of imbalances may be grounds for exclusion of RES producer from the balancing group of the Guaranteed Buyer

On 23d December and today (on 30th December) the hearing of the Resolution #641 in NEURC was postponed. So still hope that EUEA proposals will have a chance to be taken into consideration. Today NEURC mentioned, that they are waiting for the conclusion of Antimonopoly Committee. 

2. On 31st December 2020 (Tomorrow) at 10.00 am an open hearing of the NEURC will be held on the settlement of debts on the electricity market. There are no draft documents in these regards yet.

3. Payments of Guaranteed Buyer to RES producers (according to the official website) for October 100%, for November 16,7%, December 11,5 %.

4. Today NEURC has amended the Market Rules and prescribed norms regulating the restriction of renewable generation under the command of NEC Ukrenergo for unloading (outside the balancing market) and determining the cost of such a service. Details in UA...

5. On the week of 10th January we'll organize the EUEA members' online meeting to discuss the current RES situation on the market, next steps and plans. Later we'll inform you about the details of the meeting.

PS: As you know, the new acting Minister of Energy of Ukraine is Yuri Vitrenko, and he was set a task by Prime-minister of Ukraine - Denys Shmygal, to prepare the proposals of the RES sector stabilization in short terms. So that will be one more topic to discuss.

Шановні члени ЄУЕА,

З цим листом хочемо повідомити Вам наступне:

1. Минулого тижня ЄУЕА надіслало лист до НКРЕКП з пропозиціями щодо проекту постанови НКРЕКП “Про затвердження Змін до постанови НКРЕКП від 26 квітня 2019 року №641 про відповідальність за небаланси”  зокрема: 

• Не зменшувати калькуляцію вартості послуги на збільшення частки виробництва електроенергії з ВДЕ на 20%, оскільки ці 20% не передбачені Державним бюджетом України.
• Компенсація повинна бути чітко визначена як "послуга", яку Гарантований покупець надає виробникам ВДЕ для усунення їх дисбалансу (операція, що оподатковується ПДВ), що дозволить обом сторонам сплатити ПДВ.
• Вилучити статтю про наступне: несвоєчасна оплата за врегулювання дисбалансів може бути підставою для виключення виробника ВДЕ з балансуючої групи Гарантованого покупця.

23 грудня та сьогодні (30 грудня) слухання Постанови № 641 НКРЕКП було відкладено. Тож все ще сподіваємось, що пропозиції ЄУЕА матимуть шанс бути врахованими. Сьогодні НКРЕКП зазначила, що вони чекають на висновок Антимонопольного комітету.

2. 31 грудня 2020 року (завтра) о 10.00 відбудеться відкрите слухання НКРЕКП щодо врегулювання боргів на ринку електроенергії. Проектів документів з цього приводу поки що немає.

3. Виплати Гарантованого покупця виробникам ВДЕ (згідно з офіційним веб-сайтом) за жовтень 100%, за листопад 16,7%, грудень 11,5%.

4. Сьогодні НКРЕКП внесла зміни до Правил ринку та прописала в них норми, які регламентують обмеження відновлюваної генерації за командами НЕК «Укренерго» на розвантаження (поза балансуючим ринком) та визначення вартості такої послуги. Деталі...

5. У тиждень 10 січня ми організуємо онлайн-зустріч членів ЄУЕА, щоб обговорити поточну ситуацію з ВДЕ на ринку, наступні кроки та плани. Пізніше ми повідомимо вас про деталі зустрічі.

PS: Як відомо, новим в.о. Міністра енергетики України є Юрій Вітренко, перед яким Прем'єр-міністр України - Денис Шмигаль поставив завдання підготувати пропозиції щодо стабілізації сектору ВДЕ в короткі терміни. Тож це буде ще одна тема для обговорення.
